What should I do if I forgot to pay the fine after receiving the fixed penalty notice due to smoking offence?

Offender has to pay the Fixed Penalty of HK$1,500 within 21 days from the date of the fixed penalty notice. You may pay the fixed penalty in accordance to the payment instructions printed at the back of the notice, such as at post office counters, through Bank Automated Teller Machine (ATM), using ‘PPS’ through the internet, by phone or by cheque.

If the fixed penalty is not paid within 21 days, the department will issue a demand notice (i.e. Form 2) to remind you to pay the fine within 10 days from the date of the notice. If you wish to dispute liability for the offence, you should notify the Authority in writing or by using the attached notification form in Form 2. Please quote the 10-digit Reference no. shown at the top left hand corner of the notice for reference. Dispute case will be handled by the court, and you have to appear the Court for hearing and offer defense.

If you do not pay the fixed penalty or notify the Authority that you wish to dispute liability for the offence within 10 days from the date of the notice, upon an application made in the name of the Secretary for Justice, a magistrate would order and require the person to pay the fixed penalty amount, with an additional penalty of HK$1,500 and the sum of HK$300 by way of costs (HK$3,300 in total) within 14 days from the date of the order.
